Terms & Conditions
This document is intended to serve as the primary Terms & Conditions governing all purchases, services, subscriptions, deliveries and use of the Seraphina Bouquets LLC website. It has been written as a comprehensive legal document suitable for review and adaptation by legal counsel.
1. Company Information
Seraphina Bouquets LLC ('Seraphina', 'we', 'our' or 'us') is a South Carolina limited liability company operating from Mount Pleasant, South Carolina. We provide floral design services, plant sales, subscriptions, workshops, event florals and related products exclusively within our delivery area unless otherwise stated.
2. Acceptance of these Terms
By accessing our website, placing an order, purchasing a subscription, booking an event, enrolling in a workshop or otherwise doing business with Seraphina Bouquets LLC, you acknowledge that you have read, understood and agree to be legally bound by these Terms & Conditions together with our Privacy Policy, Shipping & Delivery Policy, Return & Refund Policy, Floral Subscription Agreement and Plant Policy.
These Terms apply to every transaction regardless of whether the order is placed online, by telephone, by email, through social media, in person or by any future ordering platform operated by the Company.
If you do not agree with these Terms, you should not use our website or purchase our products or services.
We reserve the right to amend these Terms from time to time. Changes become effective upon publication on our website unless otherwise required by applicable law. Continued use of our services after an update constitutes acceptance of the revised Terms.
3. Definitions
Fresh Floral Products: Bouquets, arrangements, centerpieces and other products primarily composed of fresh flowers and foliage.
Plants: Living indoor or outdoor plants sold with or without decorative containers.
Custom Design: A floral creation prepared specifically for a customer's requested style, palette or occasion.
Designer's Choice: A design in which our designers select the freshest seasonal materials while honoring the customer's chosen color palette whenever reasonably possible.
Delivery: Completion of an order by personal handoff, placement in a safe location authorized by the customer or recipient, or delivery to a reception desk, concierge or other authorized representative.
Business Day: Any day on which Seraphina Bouquets LLC is open for normal operations, excluding announced holidays or emergency closures.
4. Eligibility to Purchase
Customers represent that they are legally capable of entering into binding contracts under the laws applicable to them.
We reserve the right to refuse, cancel or limit any order that appears fraudulent, abusive, commercially unreasonable, intended for resale without authorization or otherwise inconsistent with these Terms.
We may require additional verification of identity, payment method or delivery information before accepting certain orders. Failure to provide requested verification within a reasonable time may result in cancellation.
5. Products, Nature of Fresh Flowers, and Customer Expectations
Fresh flowers are natural agricultural products. Unlike manufactured goods, every stem is unique in size, color, bloom stage, fragrance, texture and longevity. Customers acknowledge that these natural variations are an essential characteristic of fresh floral products and do not constitute defects.
Our floral designs are created individually by professional designers. No two bouquets or arrangements will ever be identical, even when prepared from the same recipe or inspired by the same reference photograph. This uniqueness forms part of the artistic value of every Seraphina creation.
Photographs displayed on our website, social media platforms, advertisements and printed materials are intended to illustrate our design style, color palette, scale and overall aesthetic. They are not representations of an exact product that will be reproduced flower-for-flower.
Whenever reasonably possible we attempt to recreate the visual character of the featured design. However, flower varieties, stem counts, bloom size, seasonal availability and natural growing conditions may require modifications while preserving the overall artistic appearance and retail value.
Flowers continue to develop after harvest. Certain blooms may arrive partially closed in order to maximize vase life. Others may naturally open significantly during the following days. Customers understand that the appearance of an arrangement on the day of delivery may differ from its appearance several days later as flowers mature naturally.
Some flowers naturally bruise, wilt or shed petals more quickly than others. Garden roses, poppies, tulips, hydrangeas, sweet peas, ranunculus and other delicate varieties have shorter decorative lives than more durable blooms. Such characteristics are inherent to the product and do not indicate poor quality.
The customer is responsible for providing appropriate care after delivery, including adding fresh water, trimming stems when applicable, avoiding direct sunlight, excessive heat, air conditioning vents and ripening fruit. Failure to provide proper care may substantially reduce the longevity of floral products.
6. Designer's Choice Orders
Designer's Choice arrangements represent one of the signature services offered by Seraphina Bouquets LLC. By selecting this option, customers expressly authorize our floral designers to exercise professional artistic judgment regarding flower varieties, textures, foliage, mechanics and composition.
Customers may communicate preferred color palettes such as Soft, Colorful, White & Green or similar preferences. We make reasonable efforts to respect these requests but cannot guarantee the availability of specific flowers or exact color tones.
The Designer's Choice option does not include approval photographs before delivery unless separately agreed in writing. Customers purchasing this option acknowledge that the principal value of the product lies in the creative interpretation of our design team rather than the reproduction of any particular arrangement.
Refund requests based solely upon personal preference, subjective artistic taste or the expectation that the arrangement would exactly resemble another design are not grounds for cancellation or refund provided the arrangement is professionally executed and materially consistent with the selected size and style.
7. Orders and Order Acceptance
All orders submitted through our website, by telephone, by email, through social media, or in person constitute an offer by the customer to purchase products or services from Seraphina Bouquets LLC. Submission of an order does not automatically create a binding contract. Every order remains subject to review and acceptance by the Company.
We reserve the absolute right to decline, cancel, limit or refuse any order for any lawful reason. Circumstances that may result in refusal include, but are not limited to, product unavailability, incorrect pricing, suspected fraud, abusive conduct, payment verification issues, impossible delivery requests, weather emergencies, safety concerns, inventory shortages, or events beyond our reasonable control.
An automatically generated confirmation email merely acknowledges that an order has been received by our ordering system. It should not be interpreted as legal acceptance of the order. Acceptance occurs only after payment has been successfully authorized and Seraphina has determined that the order can reasonably be fulfilled.
In the event that an order cannot be completed after payment has been processed, we may contact the customer to discuss available alternatives, substitute products, delivery modifications, store credit or a refund, depending upon the specific circumstances.
Customers are solely responsible for reviewing all order information before completing checkout. This includes the recipient's name, delivery address, billing information, requested delivery date, card message, contact telephone numbers and any special instructions. Errors submitted by the customer may not always be correctable after production has begun.
Because many floral products are prepared specifically for an individual order, production may begin shortly after the order is received. Once design work has commenced, certain modifications or cancellations may no longer be possible even if the scheduled delivery date has not yet arrived.
If the customer requests changes after an order has been accepted, Seraphina will make commercially reasonable efforts to accommodate the request. However, we cannot guarantee that requested modifications can be implemented once flowers have been purchased, conditioned, processed or incorporated into a design.
We reserve the right to establish reasonable order minimums, production deadlines, holiday cut-off times and advance notice requirements. During high-volume holidays such as Valentine's Day, Mother's Day, Thanksgiving and Christmas, modification and cancellation requests may be significantly more limited than during ordinary business operations.
Orders placed using fraudulent payment methods, stolen credit cards, false identities, fictitious recipient information or any deceptive practice may be cancelled immediately without notice. We reserve the right to cooperate fully with financial institutions and law enforcement authorities in connection with suspected fraudulent activity.
The customer agrees that Seraphina Bouquets LLC shall not be liable for delays, additional costs or unsuccessful deliveries resulting from incomplete, inaccurate or misleading information supplied during the ordering process.
8. Pricing, Payments, Taxes and Billing
All prices displayed by Seraphina Bouquets LLC are quoted in U.S. Dollars (USD) unless expressly stated otherwise. Prices are subject to change at any time without prior notice. A change in pricing shall not affect an order that has already been accepted and paid in full, except where an obvious pricing error has occurred.
Because fresh flowers and plants are agricultural products subject to significant market fluctuations, wholesale costs may change daily due to seasonality, weather events, import restrictions, transportation costs, labor shortages, fuel prices and worldwide supply chain conditions. Seraphina reserves the right to adjust retail pricing accordingly.
If an obvious pricing error, typographical mistake or system malfunction results in an incorrect price being displayed, Seraphina shall not be obligated to sell the product at the erroneous price. In such circumstances, we may cancel the order and issue a full refund or contact the customer to obtain approval before proceeding at the correct price.
Payment in full is generally required before production begins unless alternative payment terms have been agreed upon in writing for approved corporate accounts or event clients. Orders may not enter production until payment authorization has been successfully completed.
We reserve the right to accept or decline specific payment methods. Accepted payment methods may include major credit cards, debit cards, digital wallets, Shopify Payments and any additional payment services offered through our website from time to time.
Customers represent and warrant that they are authorized to use the payment method submitted. Any chargeback, reversed payment or payment dispute initiated in bad faith may result in suspension of future purchasing privileges and collection efforts to recover all amounts legally owed.
Applicable federal, state and local sales taxes will be calculated based upon the delivery location and applicable law. Customers remain responsible for all taxes legally due in connection with their purchases.
Shipping charges, delivery fees, service charges or optional upgrades are displayed separately during checkout whenever applicable. Unless expressly stated, these charges are not included within the listed product price.
Promotional discounts, coupon codes, introductory offers and subscription incentives cannot be redeemed for cash and generally may not be combined unless expressly permitted. Seraphina reserves the right to modify or discontinue promotional programs without prior notice.
Invoices, receipts and order confirmations are generated electronically. Customers are responsible for maintaining accurate billing information and current email addresses to ensure receipt of transactional communications.
9. Delivery, Pickup and Transfer of Responsibility
Delivery dates requested by customers are treated as good-faith requests rather than absolute guarantees unless Seraphina Bouquets LLC has expressly agreed in writing to a guaranteed delivery time. While we make every reasonable effort to deliver within the requested timeframe, delays may occur due to traffic conditions, severe weather, road closures, accidents, vehicle failures, public emergencies, unusually high order volume, or other circumstances beyond our reasonable control.
Unless otherwise stated on our website, deliveries are made within the geographic service area designated by Seraphina. We reserve the right to decline deliveries outside our normal service area or to apply additional delivery charges when extended travel is accepted.
Customers are solely responsible for providing complete and accurate delivery information, including the recipient's full name, street address, apartment or suite number, business name, gate codes, building access instructions, telephone numbers, and any other information reasonably necessary to complete delivery. Seraphina shall not be responsible for delays or unsuccessful deliveries caused by inaccurate or incomplete information.
If no individual is available to receive the order, our delivery personnel may, when appropriate, leave the floral product in a location reasonably believed to be safe, protected, and suitable for perishable products, provided such action is authorized by the customer, requested by the recipient, or considered commercially reasonable under the circumstances.
Delivery to a receptionist, concierge, front desk employee, security guard, administrative assistant, hospital staff member, funeral home representative, event coordinator, or other person reasonably appearing to accept deliveries on behalf of the recipient shall constitute completed delivery.
Certain institutions, including hospitals, schools, hotels, retirement communities, office buildings, military facilities, and secured residential communities, may impose delivery restrictions beyond our control. Customers acknowledge that Seraphina cannot override institutional policies or guarantee direct access to recipients in such locations.
Once delivery has been completed, the risk of loss, theft, accidental damage, vandalism, deterioration caused by weather, or any other event affecting the floral product transfers to the customer or recipient. Seraphina shall not be responsible for products left unattended when delivery instructions expressly or impliedly authorize such placement.
Extreme temperatures can significantly reduce the longevity of flowers and plants. Customers assume responsibility for products that remain outdoors after delivery, including exposure to excessive heat, freezing temperatures, heavy rain, direct sunlight, wind, or other environmental conditions.
Pickup orders must be collected during the agreed pickup window. Products not collected within a reasonable period may experience reduced freshness or quality. Seraphina is not responsible for natural deterioration resulting from delayed pickup by the customer.
During hurricanes, tropical storms, flooding, mandatory evacuations, severe weather advisories, or other emergencies affecting safe travel within the Charleston area, Seraphina reserves the right to postpone deliveries, modify delivery routes, suspend operations temporarily, or cancel orders when necessary to protect employees, customers, and property. In such circumstances, customers will be offered an alternative delivery date, store credit, or refund where appropriate.
10. Cancellations, Order Changes and Refund Eligibility
Because the majority of our products are handcrafted specifically for each customer using perishable materials purchased for a particular order, cancellation rights are substantially more limited than they would be for mass-produced retail merchandise. Customers acknowledge that flowers are ordered, conditioned and designed specifically for the requested delivery date, making many orders impossible to resell.
Orders may generally be cancelled without penalty only if production has not yet begun and no flowers or materials have been specially purchased or reserved for the order. Once production has commenced, Seraphina Bouquets LLC may retain all or part of the purchase price to compensate for labor performed, flowers purchased, administrative costs and materials already committed to the order.
Requests to change delivery dates, delivery addresses, card messages, bouquet size, color palette or other order details should be submitted as soon as possible. While we will make commercially reasonable efforts to accommodate requested modifications, we cannot guarantee that changes will be possible once flowers have been processed or incorporated into a design.
Custom floral designs, event florals, weddings, corporate installations, subscription orders already in production, special-order containers, imported flowers and products specifically obtained at the customer's request are generally non-cancellable and non-refundable except where required by applicable law.
Refunds will not be granted solely because the customer or recipient prefers a different flower variety, expected a larger bloom size, dislikes the artistic style, anticipated an exact replica of a reference photograph, or experiences natural changes in flower appearance after delivery. Such circumstances are inherent characteristics of fresh floral products and do not constitute product defects.
If a customer believes that a delivered product does not substantially conform to the order placed, the customer must notify Seraphina promptly and provide clear photographs of the product in the condition received. Failure to report concerns within a reasonable period after delivery may limit our ability to investigate or offer an appropriate resolution.
Where Seraphina determines, in its sole but reasonable discretion, that a legitimate quality issue exists, the Company may elect to provide one of the following remedies: replacement of the product, partial refund, store credit, repair of the arrangement where feasible, or another commercially reasonable solution. The specific remedy shall depend upon the nature of the issue, flower availability, delivery timing and the surrounding circumstances.
Under no circumstances shall Seraphina Bouquets LLC be responsible for consequential damages, emotional distress, lost business opportunities, missed celebrations or indirect losses arising from a cancelled order, delayed delivery or dissatisfaction with the artistic style of a floral arrangement, except where such limitation is prohibited by applicable law.
11. Subscriptions, Workshops, Events and Corporate Services
Seraphina Bouquets LLC offers recurring floral subscriptions, educational workshops, corporate floral programs, weddings, private events and other specialty services. These offerings are governed by these Terms & Conditions together with any additional written agreement, proposal, quotation, event contract or subscription agreement applicable to the particular service purchased.
Floral subscriptions are intended to provide recurring deliveries of seasonal floral designs. Subscription customers acknowledge that every delivery will feature different flowers based upon seasonality, market availability and the creative direction of our designers. Identical bouquets are neither promised nor expected unless expressly agreed in writing.
Subscription schedules, billing frequency, minimum commitments, pauses, cancellations and modifications are governed by the Floral Subscription Agreement. In the event of any conflict between these Terms and the Floral Subscription Agreement, the latter shall control with respect to subscription-specific matters.
Workshops are educational experiences designed for recreational enjoyment. Participants assume responsibility for their own conduct and agree to follow all reasonable safety instructions provided during the event. Seraphina shall not be liable for injuries resulting from misuse of floral tools, sharp instruments, candles, glass containers or other workshop materials except to the extent caused by our negligence.
Workshop reservations may require advance payment and space is generally limited. Failure to attend a reserved workshop without prior notice may result in forfeiture of all or part of the registration fee depending upon the cancellation policy applicable to that event.
For weddings, private events and large floral installations, quotations are estimates based upon information available at the time they are prepared. Final pricing may change if the client requests modifications, increases quantities, changes flower varieties, expands the event scope or requests additional labor, rentals or delivery services.
A signed proposal together with any required deposit constitutes authorization for Seraphina to reserve production capacity, schedule staff, purchase flowers and secure specialty materials. Deposits may therefore become partially or fully non-refundable once these commitments have been made.
Corporate floral services may be governed by separate service agreements establishing delivery schedules, replacement frequency, invoicing terms, payment deadlines, access procedures and responsibilities for containers or rental equipment. These Terms supplement, but do not replace, any such written agreement.
We reserve the right to decline participation in events or services that present unreasonable safety risks, discriminatory conduct, unlawful activities, abusive behavior toward our personnel or circumstances that would prevent us from providing services consistent with our professional standards.
12. Website Use, Intellectual Property and User Content
All content available through the Seraphina Bouquets LLC website, including but not limited to text, product descriptions, photographs, floral recipes, artwork, graphics, logos, videos, page layouts, branding elements, icons, downloadable materials, source code, design concepts and other content (collectively, the 'Website Content') is owned by or licensed to Seraphina Bouquets LLC and is protected by United States and international copyright, trademark and other intellectual property laws.
The Seraphina name, logo, trade dress, floral style, marketing materials and any associated trademarks or service marks may not be copied, reproduced, imitated or used in any manner likely to cause confusion without our prior written consent. Nothing contained on this website grants any license or right to use our intellectual property except as expressly stated in these Terms.
Customers are granted a limited, non-exclusive, non-transferable and revocable license to access and use this website solely for personal, lawful and non-commercial purposes. This license does not permit the reproduction, republication, resale, scraping, automated extraction, reverse engineering or commercial exploitation of any portion of the website without prior written authorization.
You agree not to use the website in any manner that may interfere with its normal operation, compromise its security, introduce malicious software, attempt unauthorized access to restricted areas, overload servers, harvest personal information, or otherwise violate applicable law or the rights of other users.
If you submit photographs, reviews, testimonials, comments, social media tags or other content relating to Seraphina Bouquets LLC ('User Content'), you represent that you own or otherwise control the rights necessary to submit such material and that your submission does not infringe the rights of any third party.
By voluntarily providing User Content, you grant Seraphina Bouquets LLC a worldwide, perpetual, non-exclusive, royalty-free license to reproduce, publish, display, adapt, distribute and otherwise use such content for marketing, educational, portfolio and promotional purposes in any media now known or later developed. You retain ownership of your original content, but grant us the foregoing usage rights unless prohibited by applicable law.
We reserve the right, but not the obligation, to remove, edit, refuse or discontinue displaying any User Content that we reasonably determine to be unlawful, defamatory, misleading, abusive, discriminatory, fraudulent, obscene, infringing, commercially inappropriate or otherwise inconsistent with our brand values or these Terms.
Any unauthorized use of our intellectual property or website content may result in legal action, including claims for injunctive relief, monetary damages, recovery of attorneys' fees where permitted by law and any other remedies available under applicable law.
13. Disclaimer of Warranties and Limitation of Liability
To the fullest extent permitted by applicable law, all products and services provided by Seraphina Bouquets LLC are offered on an 'as is' and 'as available' basis. While we are committed to providing exceptional quality and professional service, we do not guarantee that our website will always be uninterrupted, error-free, secure or available at every moment.
Because fresh flowers, foliage and living plants are natural products, Seraphina does not warrant that every bloom will open identically, last for a specific number of days, possess a particular fragrance, or maintain an exact appearance after delivery. Vase life varies according to flower variety, environmental conditions and customer care after receipt.
Except where prohibited by law, Seraphina expressly disclaims all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement and any warranties arising from a course of dealing or trade usage. Nothing in these Terms excludes rights that cannot legally be waived under applicable consumer protection laws.
In no event shall Seraphina Bouquets LLC, its owners, employees, contractors, designers, delivery personnel, affiliates or suppliers be liable for any indirect, incidental, consequential, exemplary, punitive or special damages, including but not limited to lost profits, lost business opportunities, emotional distress, reputational harm, interruption of business, loss of data or loss of goodwill arising out of or relating to the purchase or use of our products or services.
Our total cumulative liability arising from any claim related to a particular order shall not exceed the total amount actually paid by the customer for that specific order, except where a greater remedy is required by applicable law.
Customers agree that flowers and plants are intended for decorative enjoyment and should not be consumed unless specifically identified as edible. Seraphina shall not be responsible for injury, illness or damage resulting from misuse of products, improper handling, failure to supervise children or pets, allergic reactions unknown to us, or use inconsistent with normal decorative purposes.
The limitations contained in this section are fundamental elements of the agreement between the customer and Seraphina Bouquets LLC. The pricing of our products reflects the allocation of risk described herein, and these limitations shall survive completion, cancellation or termination of any order.
14. Indemnification, Governing Law and Dispute Resolution
To the fullest extent permitted by applicable law, customers agree to defend, indemnify and hold harmless Seraphina Bouquets LLC, its owner, employees, contractors, designers, delivery personnel and affiliates from and against any claims, demands, liabilities, losses, damages, judgments, costs and reasonable attorneys' fees arising from the customer's breach of these Terms, misuse of our products or services, violation of applicable law, infringement of the rights of a third party, or inaccurate information supplied during the ordering process.
This indemnification obligation includes claims brought by recipients, guests, invitees, property owners or third parties when such claims arise from information, instructions or actions provided by the customer rather than from the negligence or willful misconduct of Seraphina Bouquets LLC.
These Terms & Conditions, together with any dispute arising out of or relating to the purchase of products or services from Seraphina Bouquets LLC, shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of laws principles.
The parties agree to make a good-faith effort to resolve any disagreement through direct communication before initiating formal legal proceedings. Customers are encouraged to contact Seraphina promptly so that concerns may be investigated and, where appropriate, resolved through replacement products, store credit, refunds or other mutually acceptable solutions.
If a dispute cannot be resolved informally, the parties agree that any legal action shall be brought in the appropriate state or federal court having jurisdiction in Charleston County, South Carolina, unless another venue is required by mandatory law. Each party submits to the personal jurisdiction of those courts for the resolution of disputes arising from these Terms.
To the maximum extent permitted by law, customers waive any right to participate in a class action, representative proceeding or consolidated action against Seraphina Bouquets LLC. Each claim shall be brought solely on an individual basis.
If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid provision shall be interpreted as closely as possible to reflect the original intent while remaining enforceable under applicable law.
Our failure to enforce any right or provision of these Terms on one occasion shall not constitute a waiver of that right or of any other provision in the future. No waiver shall be effective unless made expressly in writing by an authorized representative of Seraphina Bouquets LLC.
15. General Provisions
These Terms & Conditions, together with our Privacy Policy, Shipping & Delivery Policy, Return & Refund Policy, Floral Subscription Agreement, Plant Policy and any written proposal, invoice or service agreement applicable to a particular transaction, constitute the entire agreement between the customer and Seraphina Bouquets LLC regarding the subject matter of the purchase. They supersede all prior oral or written communications relating to that transaction.
We may communicate with customers electronically through email, text message or other contact information voluntarily provided during the ordering process. Electronic notices, invoices, receipts, confirmations and policy updates satisfy any legal requirement that such communications be provided in writing, to the extent permitted by applicable law.
Seraphina Bouquets LLC shall not be considered in breach of these Terms or otherwise liable for any delay or failure to perform resulting from events beyond our reasonable control. Such events include, without limitation, hurricanes, tropical storms, floods, fires, severe weather, epidemics, pandemics, labor disputes, utility failures, internet outages, supplier shortages, transportation interruptions, governmental actions, civil unrest or other force majeure events. Performance shall be suspended only for the duration of the event and resumed as soon as reasonably practicable.
Customers may not assign or transfer any rights or obligations arising under these Terms without the prior written consent of Seraphina Bouquets LLC. We may assign our rights or obligations in connection with a merger, acquisition, sale of assets, corporate restructuring or other lawful business transaction.
No partnership, joint venture, employment, franchise or agency relationship is created by these Terms or by the purchase of products or services from Seraphina Bouquets LLC. Each party acts solely as an independent contracting party.
Section titles and headings are included solely for convenience and shall not affect the interpretation of these Terms. Words used in the singular include the plural where appropriate, and references to one gender include all genders whenever the context so requires.
These Terms are intended to be interpreted in a commercially reasonable manner consistent with applicable law. If any ambiguity exists, it shall not be construed against either party solely because one party drafted the document.
We reserve the right to amend these Terms from time to time to reflect changes in our business operations, technology, legal requirements or industry practices. The version published on our website at the time of purchase shall generally govern the applicable transaction unless a later version is required by law.
Questions regarding these Terms may be directed to Seraphina Bouquets LLC using the contact information published on our official website. We encourage customers to contact us before placing an order whenever clarification is needed regarding our policies or services.
By placing an order or otherwise using our services, you acknowledge that you have carefully read these Terms & Conditions, understand their contents and voluntarily agree to be legally bound by them.
Effective Date
These Terms & Conditions are effective as of the date published on the Seraphina Bouquets LLC website and remain in effect until replaced by a subsequent version.
Appendix A Plant Policy
Seraphina Bouquets LLC
This Plant Policy applies to all living plants sold by Seraphina Bouquets LLC. Because plants are living organisms, each specimen is unique and will naturally vary in appearance, size and growth. By purchasing a plant from Seraphina, you agree to the terms below in addition to our Terms & Conditions, Shipping Policy and Return & Refund Policy.
1. Natural Variation
Every plant is unique. Size, height, number of leaves, coloration, variegation, shape, growth pattern and maturity naturally vary from plant to plant. Product photographs are representative examples only and are not exact images of the plant you will receive.
2. Containers and Pots
Decorative pots shown in photographs are representative of our design style. Plant containers may vary slightly in color, finish, texture, material or shape depending on availability. Customers may request a preferred color or style in the order notes, but specific containers cannot be guaranteed.
3. Availability and Substitutions
If a particular plant variety or container becomes unavailable, Seraphina may substitute a comparable plant or container of equal or greater value while preserving the overall appearance and style of the product whenever reasonably possible.
4. Plant Care
Customers are responsible for providing appropriate light, water, humidity, temperature and ongoing care after delivery. Care recommendations are general guidelines and actual requirements vary by species and growing environment.
5. Delivery and Inspection
Plants should be inspected promptly upon delivery. Minor soil displacement, natural leaf movement or slight cosmetic imperfections resulting from transportation are common and do not necessarily indicate damage or poor quality.
6. Returns and Claims
Because plants are living products, returns are generally not accepted after delivery except where a verified quality issue existed at the time of delivery. Any concern should be reported promptly and supported with photographs so that we may evaluate the situation fairly.
7. Toxicity
Some plants may be toxic to pets or humans if ingested. Customers are responsible for determining whether a particular plant is appropriate for their household or workplace. Seraphina Bouquets LLC is not responsible for injuries resulting from improper handling or ingestion.
8. Limitation of Liability
Seraphina does not guarantee continued growth, flowering or long-term survival of any plant after delivery, as these outcomes depend upon environmental conditions and customer care. Our liability is limited as provided in our Terms & Conditions and Return & Refund Policy.
9. Changes to this Policy
We may revise this Plant Policy periodically to reflect changes in our products, business practices or legal requirements. The version published on our website at the time of purchase generally governs that transaction.
Contact Information
For questions regarding plant selection or care, please contact Seraphina Bouquets LLC using the contact information published on our website.
Effective Date
This Plant Policy is effective as of the date published on the Seraphina Bouquets LLC website.
Appendix B Floral Subscription Agreement
Seraphina Bouquets LLC
Effective Date: July 2026

2. Minimum Commitment
Every subscription requires a minimum commitment of three (3) consecutive months. The Subscriber remains responsible for all charges during this initial commitment period.
3. Billing
The subscription fee is automatically charged at the beginning of each billing cycle using the payment method on file. The Subscriber authorizes recurring charges until the subscription is properly cancelled.
4. Bouquet Design
Subscription bouquets are Designer's Choice creations. Flower varieties, colors, textures, containers, and wrapping may vary according to seasonality and availability. Exact duplication of previous bouquets is neither expected nor guaranteed.
5. Complimentary Delivery
Complimentary delivery is included only for the delivery address selected when the subscription begins and only while the subscription remains active. Additional charges may apply for address changes outside our standard delivery area.
6. Delivery Frequency
Available delivery frequencies are shown on the website. During the first three months the Subscriber may request an increase in delivery frequency. Requests to decrease frequency are accepted only after the initial three-month commitment has ended.
7. Address Changes
Subscribers should provide reasonable notice for address changes. We will accommodate requests when operationally possible. Delivery outside our service area may not be available.
8. Missed Deliveries
The Subscriber is responsible for ensuring someone can receive the bouquet or that a safe delivery location is available. Additional delivery charges may apply when redelivery is required because of inaccurate information or recipient unavailability.
9. Pauses
Temporary pauses are not guaranteed and are approved solely at Seraphina's discretion. Any approved pause does not automatically extend promotional pricing or alter the minimum commitment unless confirmed in writing.
10. Cancellation
Cancellation requests must be made directly to Seraphina Bouquets after completion of the minimum three-month commitment. The subscription remains active until cancellation has been confirmed by the Company.
11. Failed Payments
If a recurring payment fails, we may retry the payment, request an updated payment method, suspend deliveries, or terminate the subscription if payment cannot be collected.
12. Promotions
Introductory promotions, including discounted first bouquets, apply only under the terms advertised at the time of purchase and may not be combined with other offers unless expressly stated.
13. Modifications
Seraphina may modify bouquet offerings, pricing, delivery schedules, or operational procedures for future billing cycles. Material changes will be communicated before they become effective where required by law.
14. Limitation of Liability
Seraphina is not responsible for normal floral variation, seasonal substitutions, or circumstances beyond its reasonable control affecting delivery or flower availability.
15. Governing Law
This Agreement is governed by the laws of the State of South Carolina. Any dispute shall be resolved in accordance with the governing law provisions published by Seraphina Bouquets.
Subscriber Acknowledgement
By purchasing a floral subscription through the Seraphina Bouquets website, the Subscriber acknowledges that they have read, understood, and agree to this Floral Subscription Agreement.
